Question: I was thinking recently about all of the substances that the DEA has placed on Schedule I and how that placement makes it very difficult to do research with these substances. According to the DEA's own rules, a schedule I substance has to have no legitimate medical use AND a high potential for abuse. Since several substances have been shown to not meet those requirements for Schedule I, would it be feasible to win a lawsuit against the DEA requiring them to re-schedule the substances ((like mushrooms, LSD, and marijuana, which have huge medical potential and much lower abuse potential than commonly assumed)? Please state any relevant legal or medical background you have when answering

Some fed agencies get sued for large amts. Acid and pot do have much to offer in medicine. It's laughable to say they'r addictive. I've tried and won a number of cases in various state courts w/o a formal legal education. There'r many objections to these irrational policies, so I'd research what's already been done on this issue.

I am a little miffed at some of the answers you are getting, especially those that say the law is unconstitutional. If the Arizona law is unconstitutional then so is the Federal law, they were both written by the same man. The basis of the lawsuit is that they claim that the Arizona law violates the Supremacy clause. I don't see how this can be the case since the AZ law still requires local law enforcement to call INS once an illegal has been found. A portion of the law, designed to require employers to validate citizenship of employees was first enacted by then governor Janet Napolitano yet she seems dumbfounded by that requirement. All of this talk from Obama and Holder on the Arizona law yet not one of them has mentioned California Penal Code 834b which is essentially the same law as SB1070 in AZ. Now if you read California Penal Code 834b you will see that cities such as San Francisco and Maywood are in violation of that code by declaring themselves to be sanctuary cities. Here is the text of the Penal Code. 834b. (a) Every law enforcement agency in California shall fully cooperate with the United States Immigration and Naturalization Service regarding any person who is arrested if he or she is suspected of being present in the United States in violation of federal immigration laws. (b) With respect to any such person who is arrested, and suspected of being present in the United States in violation of federal immigration laws, every law enforcement agency shall do the following: (1) Attempt to verify the legal status of such person as a citizen of the United States, an alien lawfully admitted as a permanent resident, an alien lawfully admitted for a temporary period of time or as an alien who is present in the United States in violation of immigration laws. The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status. (2) Notify the person of his or her apparent status as an alien who is present in the United States in violation of federal immigration laws and inform him or her that, apart from any criminal justice proceedings, he or she must either obtain legal status or leave the United States. (3) Notify the Attorney General of California and the United States Immigration and Naturalization Service of the apparent illegal status and provide any additional information that may be requested by any other public entity. (c) Any legislative, administrative, or other action by a city, county, or other legally authorized local governmental entity with jurisdictional boundaries, or by a law enforcement agency, to prevent or limit the cooperation required by subdivision (a) is expressly prohibited. If the AZ law constitutes racial profiling, then why isn't this text contained in Penal Code 834b also racial profiling? "The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status." I believe that the lawsuit is politically motivated because Arizona has recently passed a law that requires all candidates to prove their citizenship before being placed on an election ballot. No birth certificate, no name on the ballot.

Arizona law mimics Federal law almost to the letter, the only (and biggest exception) is it is less intrusive on individual rights. Federal law, allows law enforcement to stop any one at any time for any reason and demand "Papers", where as Arizona law requires that the police already have made contact (ie, pulled them over for speeding, bank robbery, etc) and then have a suspicion (can't speak English, a foreign drivers license etc). The only logical reason I can see for a law suit to be filed by the Federal government is to attempt to rule it "unconstitutional" which would set the frame work for amnesty since if Arizona law is illegal and it is less restrictive than Federal law, put one and one together. And you are correct about state laws concerning marijuana, federal law expressly forbids a state from legalizing a controlled substance such as marijuana. Regardless if a person agrees or disagrees with marijuana use, every law made by a state over its use is illegal yet not a word from the government.

I think they are all bought off by the cartels. Up until now I just thought it was big business and wall street lobby contributions that paid off both political parties. Now it won't surprise me if it is all of the above. That was a major complaint I had against Bush not busting the US border towns still protecting the illegals by threatening the jobs of their local government workers if they turned any illegal into the state or fed authorities. Now Phoenix is the drug cartel hub for distribution throughout the USA. I wonder why the Black Caucus tolerates this. A 51 Billion dollar a year degradation of our society. Which politician is poor is our curiosity. Follow the money...but no one is getting an independent investigation. Of course not. They don't want to be caught. Nobody does. We want to know but we are disenfranchised and not in the loop.

LSD is highly addictive which is why it is no longer used for medical practice. And your chances of suing a government agency just so you can take drugs legally (they would probably make you have to get a prescription if they did make them legal) are nil.

For one, you cannot sue anybody until you are 18. Therefore, your parents would have to sue. Secondly, you have to prove your case. Your name is not personal information, it is considered public information. If they posted your social security number and address, THEN, they may be in trouble because that those items are considered confidential. What does Myspace have to do with any of this? Did this person obtain this information from your Myspace? If so, then there is nothing that can be done. The "articles" they have posted, are they true? If so, nothing can be done about this. Why do you feel threatened and scared? What are they EXACTLY saying? What are your damages?
