Question: My husband started his new job in April. My husband has had a few excusable absences. A couple when he was really sick and contracted a nasty virus (dr's orders) and when my son was born. He was late four times. Two times were when my son kept us up all night, he called and went straight in. Last week he was late because my daughter had breathing issues all night and sleep for both of us was impossible. She was taken to her pediatrician the same day and had severe bronchitis, close to walking pneumonia. This morning he was scheduled for work at 6am, did not know, nothing was posted Friday when he clocked out. So he went to work at his normal time at 7:30am. His supervisor pulled out the work contract, and it states it's the employee's responsibility to ensure what time they are to be to work. Every time they wanted their employees there earlier, something was posted by their time clock. There might be a 5th because of nasty road conditions, but we are unsure if he was late or not. I am not sure though. Either way, he has always called to let them know if he was running 5-10 mins late. My question, this is obviously a tardiness issue, but is he able to collect unemployment? We live in Michigan. I have no clue how this works. Please let me know any information possible. It does sound unreliable, but I do believe two of the times that had him working from 7am- 11pm and be back to work at 6am the next day. The company also made him work through his lunch breaks while deducting a half hour out of each day of pay. Also, my husband just told me his schedule said 7:30am-5pm all throughout this week. Never once did his supervisor get his attention to be to work early, nor was it written by the time clock. I pulled out his handbook, and it says management is to notify the employees of any schedule changes. There is not a number of tardies he can have. The only thing it says is excessive tardies could possibly be cause for dismal of employment. A hunch... he is 31 years old. Every place of employment he has had, 4 places in 14 years, only off of work for 1 will all state he is reliable. This place was a stepping stone for a better future. I won't go into detail about his life and experiences and why a better education is impossible for him, but I will tell you this, he is reliable. He is a hard worker and provides for his family perfectly fine, except for this minor set back. I work, and I provide just as much, so before you judge a man that works almost 60 hrs a week as being unreliable based on a yahoo forum, especially when the past five years he has had perfect attendance, you should go back to your mom and dad for some added morals and manners! Top contributor, huh? Why don't you pack up the pc and get a life!

I think it would be difficult for him to get unemployment because it would appear that he was being unreliable.However I do the hiring and terminations for the company I work for and I wouldn't consider that track record as being worthy of termination,It isn't great but not the worst I've seen by MILES. I do get tired of people using there children as excuses or lack of sleep. I go to work even If I have had zero sleep and that happens frequently, sometimes I am unable to sleep for two or three days yet I still go to work,its a very inadequate and annoying excuse for lateness or missed days. employees will use "valid" sounding excuses every time so its up to the human resources person to determine if its too much they usually don't take into consideration WHY someone is late or missing work just the amount and if that amount exceeds what the company policy deems appropriate or acceptable then they terminate the employee and no in those cases unemployment benefits would not be available. Id ask to see the company policy regarding missed days and lateness, if they do not have such a document to provide you then he has a chance, most likely they will send you a copy of there policy and you will find that he did in fact exceed there limits.

As much as you'd like to think otherwise, the only valid reasons for absence tardiness were his illness and (possibly) the birth of the child. TWO people do not need to stay up all night when children are whiny and/or ill. My wife and I raised two kids with both of us working. We didn't use those excuses for absence and/or tardiness. If your husband can't sleep well with the kids crying, he needs to get himself a good pair of noise silencers for his ears. I can understand why he was terminated for that number of absences/tardiness in only eight months. The employer will deny his unemployment, and his record will support the employer.

Unemployment may be denied in his case because of excessive tardiness and absences. It's an employee's responsibility to get himself to work and the employer really doesn't care if your children are sick or the roads are bad. 5 - 10 minutes late too many time would be enough for me to consider terminating him. Calling in to tell them your are late doesn't negate the fact that you ARE late. He will find out when he files his claim whether or not it will be approved.

It does "sound" unreliable - he is unreliable. If he wants a job where it doesn't matter if he strolls in 5, 10 mins late... Go to college, get a masters degree and he probably won't get in trouble for being a few minutes late. But he works at an hourly job where he needs to be there and be on time. WAY too many excuses WAY too often... He can apply for unemployment. But don't expect to qualify.

Your husband should apply anyways. here in Texas our workforce commission really trys to get people there unemployment expecially if the reasonwhy they were fired is a little sketchy. Also if he is denied he can always APPEAL and be given another look at his file. Im sure he will win... goodluck!

usually you have to prove wrongful dismissal. You will be required to write a letter to show your side of the story. Most times the file will be accepted unless you can not prove that the dismissal was not warranted. Good luck. Deal only with the Unemployment agency and not with the former employer.
