Question: I am currently on a L1 Visa and I am still working with the same company that sponsored the Visa. I am going to school this fall and so applied for COS L1 -> F1. Usually I-539 COS takes 2.5 months and so I applied during the first week of May. To my surprise, my petition was approved in 10 days. And my approval notice says my F1 petition is valid from the approval date. I still have 2 months for school. Can I continue to work for my employer until July end? Please help. Fred - Thank you for the "very encouraging" answer. Even if your answer was right, I think there is a better way of putting it. Technically I didnt do anything wrong here. I just received the notice by mail today and how am I supposed to know the start date until I receive the letter. I got an infopass appointment for tomorrow with USCIS field office and going to see them.

If you are still working, you have already violated the terms of your F-1 status. The day your application for a change of status was approved (it's not a petition), your L-1 status ended and your F-1 status began. You cannot be in two non-immigrant statuses at the same time. You are now in the F-1 status. You are no longer in the L-1 status. If you are working, you are working illegally. If you are working illegally, you are subject to arrest and removal. If you worked for a single minute while in the F-1 status, you are now out-of-status. You cannot work tomorrow, let alone until the end of July. You are not eligible for reinstatement as an F-1 because you engaged in unauthorized employment. You are currently out-of-status, deportable, and have no way to fix it without leaving the U.S., obtaining an F-1 visa, and returning as an F-1 student.
